Terms and Conditions of Business

We don’t believe in ‘small’ print, so our terms are listed in readable large font.

You are strongly advised to read our Terms and Conditions of Business prior to placing your order. If you have any questions, please email info@gizfab.com.

1. Acceptance of Terms

Unless otherwise stated in writing by ourselves, orders are only accepted on the following terms and conditions. Where these terms are contrary to any stipulations of the buyer’s terms, the following are deemed to have been accepted and take precedence under English Law.

2. Quotations and Contracts

Written quotations, online prices, and brochure prices are subject to our written confirmation upon receipt of the buyer’s order. No contract shall be concluded until such written confirmation is given prior to the commencement of manufacture.

3. Rates

Our standard workshop rate for fabrication is £40 per hour. Trade rates are negotiable; please ask for details.

4. Pricing and Taxes

All prices are nett, ex-delivery costs. For exports, any customs, duty, or local tax will be the responsibility of the buyer.

5. Bespoke / Custom Work

A 25% non-refundable deposit is required for any Custom Work. We do not offer a static warranty period for custom work; however, we will work with you to rectify issues after the work leaves our premises (see Clause 17). Please refer to Clause 24 for our cancellation policy.  

 

6. Storage and Vehicle Release

  • Workshop Storage: Vehicles stored in our workshop that are mobile but cannot be moved due to a lack of keys will be charged at £5 per day (Maximum £25 per week). Charges do not apply if we have the keys or if the vehicle is immobile due to active work being carried out.  

     

  • Vehicle and Part Release: No vehicles or parts will be removed from the premises until all bills are settled in full. Under NO CIRCUMSTANCES will items be released until final settlement is received.

7. Price Amendments

We reserve the right to amend prices without notice to cover increases in materials, services, labour, tax, or duty incurred between order confirmation and delivery. Reasonable notice will be given where possible.

8. Credit Accounts

Clients with proven credit facilities will be invoiced after dispatch on a 7-day account settlement. GizFab operates a late payment penalty of £0.75 per day, backdated to the date of the invoice. Recovery costs for overdue accounts will be added to the debt.

9. Payment Methods

Buyers without credit facilities must pay in full via Cash, PayPal, or BACS:

10. Variations and Dimensions

Dimensions quoted are approximate and may vary by +/- 5%. For bespoke goods, the buyer accepts and pays for any variation. All colours, materials, and tolerances in brochures or websites are deemed approximate.

11. Force Majeure

We shall not be liable for loss arising from delays or failures caused by Acts of God, war, strikes, fire, flood, breakdown of machinery, or any other causes beyond our reasonable control.

12. Delivery and Lead Times

All lead times are approximate and exclude weekends and UK Bank Holidays. If a product is required urgently, this must be requested in writing at the time of order. We reserve the right to dispatch in instalments. Quantity variations of up to 10% shall not be grounds for rejection.

13. Title and Risk

  • Storage: If the buyer fails to collect goods within 10 working days of notification, we may store them at the buyer's expense.

  • Risk: Risk passes to the buyer upon delivery to the carrier or leaving our premises.

  • Ownership: Title remains with GizFab until full payment is received. We reserve the right to enter the buyer’s premises to recover goods if payment is not made.

14. Claims for Loss or Damage

We and the courier must be informed in writing:

  1. Within 5 working days of the invoice if goods are not delivered.

  2. Immediately upon delivery for visible damage (noted on the consignment note).

  3. Within 3 working days of arrival for all other damage claims.

15. Suspension of Deliveries

Failure to make payment entitles us to delay, suspend, or cancel any and all deliveries.

16. Attempted Deliveries

The buyer is liable for additional charges arising from attempted deliveries if incorrect details were provided or if the premises were closed.

17. Liability and Inspection (PLEASE READ CAREFULLY)

  • The buyer shall inspect goods upon delivery. Goods signed for and then found to be damaged shall not be repaired, replaced, or refunded.

  • Defects due solely to workmanship must be notified within 10 working days of delivery (or discovery for latent defects), and in any event within 2 months.

  • Warranty does not cover wilful damage, negligence, incorrect storage, or fair wear and tear.

  • GizFab will not be held accountable for remedial modifications taken to a 3rd party.

18. Braces

Supplied with a limited 1-year warranty. This covers fractures in welds due to manufacturing errors only. It does not cover impact damage, "slammed" vehicles (designed for drops up to 40mm), or paint/powder coating corrosion.

19. Exhausts and Manifolds

GizFab offers a 2-year guarantee warranty to the original purchaser (non-transferable). Warranty covers repair only. Shipping to us is the buyer's responsibility; return shipping is ours.

20. Intellectual Property

The buyer indemnifies us against all claims arising from infringements of patents, copyrights, or trademarks resulting from the buyer's instructions.

21. Proofs and Drawings

Visuals produced by GizFab are copyrighted. They may not be reproduced or given to 3rd parties without written consent.

  • Includes two (2) free amendments.

  • Further amendments: £40/hr or £30 flat fee per proof.

  • Visuals supplied prior to order: £80 per proof (refundable upon confirmed order).

22. Website Images

Permission to use images of work on our website is granted to GizFab unless we are notified otherwise in writing within 60 days of delivery.

23. Termination

We may terminate contracts immediately if the buyer enters bankruptcy, liquidation, or fails to make payments or take delivery.

24. Cancellation Policy

  • Bespoke Orders (Before production): £50.00 admin fee.

  • Bespoke Orders (Before work starts but after processing): 50% of nett order value.

  • Bespoke Orders (Once work has commenced): Full cost (100%).

  • Stock Items: Cancelled prior to postage at no charge.

25. Returns (Non-Bespoke)

Returns are at the buyer's expense. Refunds will be less the original postage charge. Items must be returned in saleable condition via recorded delivery.

26. Repairs

GizFab repairs our own work free of charge where possible. Return postage is at the client’s expense.

27. Governing Law

This contract is governed by English Law and determined by English Courts.

28. Severability

If any part of these conditions is found to be ineffective, the remainder remains binding.

29. Supersedence

These terms supersede all previous versions (October 2016).

  • With consent, to send special offers and discounts.

Data Retention

  • Tax/Sales Data: 6 years plus the current year.

  • Login Info: For as long as you are a client.

  • Data is securely destroyed at the end of the retention period.

Third Parties We Share Data With

Internal staff, data backup companies, and law enforcement when required. We use the following organizations:

  • Microsoft, Adobe, Google, Facebook, Twitter, Instagram, Bing, Yahoo.

  • Couriers: APC, Parcel Force, DPD, UPS, TNT, Yodel, DHL, Parcel2go, The Post Office.

  • Partners: HMRC, Hardrace, BC Coilovers.

Your Rights

You have the right to access, correct, or delete your data, and to withdraw consent at any time. To protect confidentiality, we will verify your identity before actioning requests.
